To protect is to limit capacity?

On a site www.e1.ru the information about the fact that prime minister Michael Fradkov has signed the decision of government, according to which employers can not assign foreigners on the trade in alcohol and in medicines, has been recently published. Since April, 1st, 2007 it will be forbided to employers to hire foreigners as the salesmen of stores and tents, workers of markets and street trade. President Vladimir Putin has supported the initiative of prime minister and has suggested not to limit the action of the decision of 2007. In the article it was indicated, that in the opinion of  the head of  Ministry of Health and Social development,“thus, it will be possible "to legalize" working labour, to protect their rights on the worthy labor, worthy wage, social maintenance, derive from the shadow and to progressively begin improving the situation in this area.” Arkady Mayfat, vice-head of the collegium of advocates “The Private Law”, comments the situation:
“According to the civil code such measures should be imposed by the law because the prohibition to work in the certain areas is the limitation of the capacity of the citizens of other countries. Consequently a special law which would limit the capacity of foreigners should be passed. It is necessary to mean, that any actions in this area which are accepted by Russia, can be reciprocally entered in the indicated countries, but already in relation to the Russian citizens. Certainly, in this case the indicated measures concern citizens, most likely, the countries of Transcaucasia and Central Asia, while Russian inhabitants in essence search for work in Europe. Therefore the probability that these two groups will cross in the near future is extremely small. But it cannot be forgotten that the qualified Russian personnel works in these states, and if the relations between the countries begin to be aggravated, then the adoption of this law can rather adversely reflect in them. In the article it was also expressed the opinion about the fact that this measure will make it possible to legalize foreign working labour. In my opinion, it will be impossible to solve this problem in this way: when a foreigner will be obliged to register, to obtain a migratory card, to conclude the labor contract, speech about the limitation of capacity does not go... "
