Dispute with Municipality for the land

The task:
It was necessary to prove the illegality of the decision of the city executive about the withdrawal of a land section for the building.

The essence of the lawful conflict:
An owner of a small woodworking enterprise encountered with a fact that he saw, how some unknown to him people were clogging pegs and placing a fence on his territory. In reply to all questions they produced him the decision of the city executive about the withdrawal of a land section for the building of uninhabited real estate. There were some buildings and constructions in his property, near to which the building was supposed. Thus the part of the real estate, according to the decision of the city executive, was supposed to be simply taken down.

The complexity of the case:
First, the land section, on which the real estate was located, has not been issued in the property though the application and all necessary for it documents have been beforehand submitted to appropriate authorities.
Secondly, there was a legal dispute in occasion of, whether the construction located on a section (crane runways), object of the real estate or not though earlier the official state certificate has been given out on it.

The sum:
The court has admitted the decision of the city executive illegal.
